How to Handle a Copyright Complaint on Amazon: A Guide for Sellers

If you're an Amazon seller, receiving a copyright complaint can be a frustrating and daunting experience.

But don't worry, we've got you covered! 


In this article, I'll discuss what to do if you receive a copyright complaint on Amazon.

What Makes You Get a Copyright Complaint?

Before we dive into what to do, let's talk about what causes copyright complaints on Amazon.

According to David Miller, there are two main areas that sellers get flagged for: photographs and verbiage.


First, let's talk about photographs.

It's essential to never simply copy and paste photographs from other sources, no matter the medium.

Doing so will almost certainly result in getting flagged at some point, causing unnecessary headaches.


The second area that can result in a copyright complaint is verbiage.

This means copying any descriptions, such as instruction manuals or features sections, which are technically someone else's copyrighted work.


What to Do If You Receive a Copyright Complaint on Amazon?

So, what should you do if you receive a copyright complaint on Amazon?

There are a few options.

First, contact the rights owner and see what the basis is behind the complaint.

If they don't respond or refuse to retract the complaint or remove the violation, you can always appeal to Amazon.


If neither Amazon nor the rights owner responds, file a DMCA (Digital Millennium Copyright Act) counter-notice.

This notice protects you from wrongful claims of copyright infringement and puts the complainant on notice.


They are then given 10 business days to file a lawsuit.

If they don't file a lawsuit within those 10 business days, the content is supposed to be automatically reinstated by Amazon.


While there is a small risk associated with filing a counter notice, it's also very successful in getting complaints removed.

Amazon has recently switched to a form that you can submit through their portal, but it's also recommended to submit an email to counter-notice@Amazon.com at the same time.
